Mining, Mineral & Energy Law

The Mining Sector in Tanzania is one of the few industries that have seen drastic changes in the past two decades. These changes have triggered a complex relationship among the stakeholders. The legislative changes were then inevitable which increased the confusion in the sector. This has necessitated fundamental changes in the way mining companies and small scale miners operate in relation to environmental, land and mining policies, ownership structures and the acquisition of rights to prospect and mine.

The complex nature of the Mining Sector has not been without conflicts and disputes of all variety including but not limited to Land, Environmental, Contractual, Employment and Labour Relations, Criminality, Business Association, Safety. In recent years the sector has witnessed a number of legislations and regulations so as to manage the sector well. Even though the sector still has administrative disputes particularly in granting of prospecting and mining rights, another area with conflicts and has witnessed strict monitoring is on environmental conservation particularly around waste management and rehabilitation of the surface of the earth disturbed during prospecting and mining.

At RightMark Attorneys we have an extensive experience in structuring mining transactions to meet legislative and regulatory and we offer a wide range of services in the mining sector.
